Terms and Conditions (also referred to as "Terms") form the entire agreement between You and The Cable regarding the use of its Autopay Service and set out the rights and obligations of all users regarding the use of the Autopay Service.

Your access to and use of the Autopay Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, and others who access or use the Service.

By accessing or using the Autopay Service, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Autopay Service.

You represent that you are over the age of 18 and have the necessary legal authority to use the payment method enrolled in the Autopay Service. The Cable does not permit those under 18 years to use the Autopay Service, or unauthorised use of JAD Wallet or credit/debit card.

Autopay Enrollment Terms and Conditions

Welcome to The Cable's Autopay Service. By enrolling in Autopay, you agree to authorize The Cable to automatically debit your JAD Wallet or charge your credit/debit card for payments due on your account according to the following terms and conditions:

1. Consent to Automatic Debits

You authorize The Cable to automatically debit the total amount due for your monthly bill from the JAD Wallet or credit/debit card on the scheduled payment date. If the payment date falls on a weekend or holiday, the payment will be processed on the next business day.

2. Enrollment and Cancellation

Enrollment in Autopay is voluntary and continues until cancelled by you or terminated by The Cable. You may cancel your enrollment in Autopay at any time via our website or by contacting customer service. Cancellation requests must be received at least five (5) business days before the next scheduled payment date to take effect for that period.

3. Account Validation and Charges

During enrollment, The Cable will make a one-time charge of $1.00 to validate your credit/debit card. This process will be repeated if the card on file is updated or changed.

4. Privacy Policy and Personal Data Collection and Retention

While using Autopay Service, The Cable may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Email address
First name and last name
Phone number
Address
Usage Data


Retention of Your Personal Data

The Cable will retain Your Personal Data only for as long as is necessary for the purposes set out in these Terms and Conditions, as may be amended from time to time. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Cable will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Disclosure of Your Personal Data

Business Transactions

If The Cable is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy of Terms and Conditions.

Law enforcement

Under certain circumstances, The Cable may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

The Cable may disclose Your Personal Data in the good faith belief that such action is necessary to:

    The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

    Detailed Information on the Processing of Your Personal Data

    The Service Providers We use may have access to Your Personal Data. These third-party vendors collect, store, use, process and transfer information about Your activity on Our Service in accordance with their Privacy Policies.

    Payments

    The Cable may use third-party services for payment processing (e.g. JAD Wallet and Caribbean Credit Card Corporation (4Cs.).

    The Cable will not store Your payment details. That information is provided directly to Our third-party payment processors whose use of Your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. The JAD Wallet Privacy Policy can be viewed at https://jad.cash/site/terms.aspx.     5. Notifications

    You will receive email notifications regarding upcoming payments, payment failures, successful payments, and retries. It is your responsibility to ensure that all contact information remains up-to-date in our system.

    6. Retry Policy

    In the event of a payment failure, The Cable will automatically retry the payment up to two (2) times. The first retry occurs three (3) days after the initial failed attempt, and a second retry follows three (3) days thereafter. If all retries fail, you will be notified and may be required to make the payment manually.

    7. Liability for Unauthorized Transactions

    You should notify us immediately if you believe your account has been accessed or an unauthorized transaction has been made. The Cable complies with applicable laws regarding unauthorized transactions, and your liability for such transactions will be limited as long as you report them within forty-eight (48) hours of occurrences.

    8. Changes to Terms and Conditions

    The Cable reserves the right to unilaterally modify these Terms and Conditions at any time. We will notify you of any changes by posting the new Terms on our website and/or sending you notification via email. Continued enrollment in Autopay after such changes constitutes your unqualified acceptance of the new Terms.

    9. Service Interruptions

    The Cable does not guarantee uninterrupted service of the Autopay system. In case of an outage or service interruption, you remain responsible for timely payment of your bill.

    10. Dispute Resolution

    Any disputes arising under these terms will be resolved in accordance with the arbitration process outlined in the Arbitration Act for Saint Christopher and Nevis in operation at the material time, unless you opt out of such a process within fourteen (14) days after the dispute arose.

    11. Governing Law

    The laws of the Federation of Saint Christopher and Nevis, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of Autopay may also be subject to other local, state, national, or international laws.

    12. Agreement to Terms

    By selecting the "I Agree" button, you affirm that you have read, understood, and agreed to these Autopay Enrollment Terms and Conditions, and you attest that you are the authorized user of the JAD Wallet or credit/debit card and that you authorize The Cable to collect payments automatically. You also agree to indemnify The Cable to the fullest extent, should it be discovered that you are not the authorized user of the JAD Wallet or credit/debit card enrolled in the Autopay Service, including reasonable legal fees incurred by The Cable, in any disputes which may arise from the unauthorized use of a JAD Wallet or credit/debit card.
